The City of Pierre regular session on June 15, 2010 at 5:30 PM with Commissioners Goodman, Harding, Huizenga, Mehlhaff, and Mayor Gill present for roll call. Jason Gunderson, Rita Linn, Jenny Hallenbeck, Mary Carter, Jill Wellhouse, and Janet Lehmkuhl signed the guest register.

 

The Pledge of Allegiance was recited followed by an invocation.

 

The agenda was approved as amended. The Public Hearing was assigned the time of 5:45pm.

 

The City Board of Commissioners met as the Canvass Board at 5:35 on Tuesday June 15th, 2010, to canvas the ballots of the June 8, 2010 election for the City of Pierre. The poll books were compared to the final tally sheets. Commissioner Goodman moved and Commissioner Huizenga seconded to accept the results of the election.

 

Commissioner Mehlhaff moved and Commissioner Harding seconded to declare Jeanne Goodman, who was duly nominated and having no opposition at the Municipal Election, elected to the Office of Commissioner for a three year term. Unanimous approval.

 

Commissioner Harding moved and Commissioner Mehlhaff seconded to approve the consent calendar which consisted of 1) Minutes of the Regular June 8, 2010 meeting; 2) New Hire Library Assistant – Jessica Lammle $8.93; 3) New Hire Substitute Library Assistant – Brandin Seibel $9.02; 4) Promotion/Salary Adjustment Community Resource Officer – Brandon Boyd $19.40; 5) Claims. Unanimous approval.

Scott Carbonneau, Community Development Coordinator, presented information about a request from the Pierre Downtown Association to install flag poles in the public right-of-way on upper and lower Pierre Street and one block either side on Dakota Ave and Missouri Ave. Scott Cameron and Rick Jensen explained that the project would consist of placing a flag pole inside the existing parking meters and would hang a banner type flag from the top that would be changed with the seasons or with community event information, but would not be used for business promotions. They explained that a committee has been formed for the project and it’s purpose is to continue the efforts to spruce up Downtown Pierre. Commissioner Goodman moved and Commissioner Mehlhaff seconded to give permission to install flag poles on public right-of-way on upper and lower Pierre Street and one block either way on Dakota Ave and Missouri Ave. Unanimous approval.

 

This being the time and place set for a public hearing on Highland’s Ridge West Petition to Vacate and Request to Rezone, Mayor Gill opened the meeting. Sharon Pruess, City Planner, explained that the hearing tonight is a continuation of the hearing from April 13th. The proposed project is to rezone the Highland’s Ridge West Subdivision from single family to multifamily with a Planned Unit Development (PUD) restricting the structures to townhomes, town houses, and condominiums. The original PUD that was presented on April 13th included an apartment complex on lot 5, that received many objections. The PUD has been revised to only include double occupancy townhomes on lot 5 where the apartment building was formerly located. Sharon explained that the Planning Commission held a public hearing on the revised project proposal on May 25, 2010 and unanimously recommended approval of the proposal. Glennis Zarecky from Midwest Development explained the proposed project and the Planned Unit Development. Ken Swedeen from 1807 Bristol Place asked if the PUD would carry forward for future development or if it is only applicable when the development is first established. Sharon explained that the PUD is filed with the court house and carries forward to any future development or redevelopment of the plats. Rita Linn from 1803 Bristol Place asked about the planned elevation of the lot 5 townhomes. Glennis Zarecky explained that the site plans do not include significant changes to the current elevation. Mary Carter from 1815 Bristol Place commented that she is comfortable with the compromise in the new site plan and PUD. Being no one else present to comment, Mayor Gill closed the public portion of the hearing. Commissioner Huizenga moved and Commissioner Goodman seconded to approve second reading and adoption of Ordinance #1670 AN ORDINANCE AMENDING SECTIONS 12-5-201 AND 12-5-701 OF ORDINANCE NO. 1265 OF THE CITY OF PIERRE, HUGHES COUNTY, SOUTH DAKOTA, RELATING TO PLANNING AND ZONING AND CHANGING THE CLASSIFICATION OF CERTAIN PORPERTY FROM THE ONE-FAMILY RESIDENTIAL DISTRICT A TO THE MULTIPLE FAMILY RESIDENTIAL DISTRICT and that it be given a number, signed, and published. Unanimous approval. Commissioner Goodman moved and Commissioner Huizenga seconded to approve Resolution #2435 vacation of old lots and streets. Unanimous approval. Commissioner Harding moved and Commissioner Mehlhaff seconded to approve Resolution #2436 replat of lots 1-6. Unanimous approval.

 

RESOLUTION NO.  2435

A RESOLUTION VACATING A PORTION OF THE PLAT OF HYDE’S THIRD ADDITION AND ERVIN’S FAIRVIEW ADDITION AND THE STREETS AND ALLEYS IN BLOCKS 3 AND 4, HYDE’S THIRD ADDTION, CITY OF PIERRE, HUGHES COUNTY, SOUTH DAKOTA.

Be it resolved by the Board of City Commissioners of the City of Pierre, Hughes County, South Dakota, that a portion of the plat of Hyde’s Third Addition and Ervin’s Fairview Addition and the following streets and alleys are hereby vacated as described below and as shown in the attached exhibit:

Lots 1-7 and Lots 38-48, Block 4, Hyde’s Third Addition

Lots 13-24, Block 8, Ervin’s Fairview Addition

That portion of Eighth Street from the east line of Calhoun Avenue, easterly to the north line of the Fourth Street Right-of-way.

That portion of Lot H1 of the Fourth Street Right-of-Way from the southwest corner of Lot 34A, Highland’s Ridge Addition, north a distance of 25’, west a distance of 170’, south a distance of 25’, and east a distance of 170’ to the southwest corner of the Lot 34A, Highland’s Ridge Addition.

That portion of Lot H1 of the Fourth Street Right-of-Way originally platted as Lot 1 and Lots 46-48, along with a portion of the adjacent alley, Block 3, Hyde’s Third Addition, City of Pierre.

That portion of Tyler Avenue from the south line of Eighth Street southerly to the north line of the Fourth Street Right-of-Way.

That portion of an alley in Block 4, Hyde’s Third Addition from the south line of the Eighth Street Right-of-Way southerly to the north line of the Fourth Street Right-of-Way.

Passed, approved and adopted by the City Commissioners of the City of Pierre, Hughes County, South Dakota, on this 15th day of June 2010.

RESOLUTION NO. 2436

A RESOLUTION APPROVING THE PLAT OF LOTS 1-6, HIGHLANDS RIDGE WEST, A SUBDIVISION WITHIN THE SOUTHWEST QUARTER OF SECTION 27, THE SOUTHEAST QUARTER OF SECTION 28 AND THE NORTHWEST QUARTER OF SECTION 34, TOWNSHIP 111 NORTH, RANGE 79 WEST OF THE 5TH P.M., CITY OF PIERRE, HUGHES COUNTY, SOUTH DAKOTA.

WHEREAS, the plat of the above described property has been executed according to statute, now therefore;

BE IT RESOLVED that the City Commission, in and for the City of Pierre, does hereby approve the said plat.

John Irvine, Building Inspector, presented a request from Jason Gunderson to move in a commercial building at 2225 E Dakota Ave. John explained that the building fits the location and purpose. The new location is zoned light industrial and the building will be used as a private shop and storage. The only concern is the aesthetics of the building in its current condition. The building has different colored sides as a result of the removal of buildings that were adjacent to it prior to being moved. Jason Gunderson explained that his intentions are to place the building on a permanent foundation and recondition the building after it’s in place and conceal any storage of items outside behind a screen fence per City Ordinance. John Irvine commented that the Occupancy Permit would only be issued upon the completion of the conditions set forth by the Commission as part of the Move In Permit. Commissioner Mehlhaff moved and Commissioner Harding seconded to approve the Move In Permit for 2225 E Dakota Ave with the condition that the exterior be reconditioned and exterior storage be concealed behind a screen fence per City Ordinance. Unanimous approval.

 

Commissioner Goodman moved and Commissioner Harding seconded to adjourn to Executive Session for Personnel Issues. 6:46pm Unanimous approval.

 

Commissioner Harding moved and Commissioner Mehlhaff seconded to reconvene. Unanimous approval.

 

Twila Hight, Finance Officer, commented that in comparing the grand total of all votes noted from each precinct poll book to the grand total of all votes counted by Hughes County, there was a discrepancy of one vote. This discrepancy is noted and will be relayed to the Hughes County Auditor.

 

Commissioner Goodman moved and Commissioner Huizenga seconded to adjourn. 7:02 Unanimous approval.
