The City of Pierre regular session on June 1, 2010 at 5:30 PM with Commissioners Goodman, Harding, Huizenga, Mehlhaff, and Mayor Gill present for roll call. Gordon Koch signed the guest register.

 

The Pledge of Allegiance was recited.

 

The agenda was approved as amended. Claims were added to the consent calendar.

Kayla Pochop, Riggs High Student Senate President, presented a request to hold a raffle as a fundraiser for the Student Senate. Kayla explained that tickets would be sold for $10 each and the prize would be a $1,000 front lawn make-over. The Student Senate has partnered with East Pierre Landscaping and Design for the expertise and materials and the Student Senate members will provide the labor. The drawing will be held in September during Homecoming week. Commissioner Goodman moved and Commissioner Huizenga seconded to approve the Riggs High Student Senate Raffle Request. Unanimous approval.

 

Sharon Pruess, City Planner, presented a request to establish the legal boundaries and create Tax Incremental District #6 for the Tax Incremental Financing currently being considered for the property at 806 and 808 W Sioux Avenue, currently occupied by Marlin’s Family Restaurant and Sioux Texaco. The proposal is to build a Hotel and Convention Center to include a restaurant, 80 guest rooms, 4,500 square feet of meeting space/board rooms, and 229 parking spaces. This is the first step of a two step process. The second step will be to approve the TIF Plan, which will be considered by the Planning Commission on June 7th and by the City Commission on June 8th. A copy of the plan was provided to the Commission for review prior to next week’s meeting. Toby Morris, Northland Securities, explained the meetings next week will go into further detail about the plan itself the financing related to it and the decisions the City will be making. The resolution tonight is only to set the legal boundaries and create the Tax Incremental District #6. Mayor Gill asked if anyone was present to comment, seeing no one present, the discussion was brought back to the Commission. Commissioner Huizenga moved and Commissioner Mehlhaff seconded to approve Resolution #2432 designating the boundaries and creating the Tax Incremental District #6. Unanimous approval. 

RESOLUTION NO. 2432

 

A RESOLUTION DESIGNATING THE BOUNDARIES AND PROVIDING FOR THE CREATION OF TAX INCRMENTAL DISTRICT NUMBER SIX, CITY OF PIERRE.

 

WHEREAS, the Planning Commission has approved a resolution declaring boundaries and recommending creation of Tax Incremental District Number Six, City of Pierre.

 

WHEREAS, the City of Pierre has the power, pursuant to SDCL 11-9-2, to create the Tax Incremental District Number Six, City of Pierre and define its boundaries.

 

THEREFORE, IT IS HEREBY RESOLVED:

1.       Authority and Declaration of Necessity. The City declares the necessity for the creation of the Tax Incremental District Number Six, City of Pierre pursuant to SDCL Chapter 11-9.

2.      Findings of Blight. The City Commission makes the following findings with regard to blight, as more fully set forth in the Blight Study on file with the Finance Officer and open to public inspection:

a.       More than 25% of the property in the District is a blighted area;

b.      The District pursuant to SDCL 11-9-10(5) contains deterioration of site and other improvements which substantially impairs and arrests the sound growth of the City, constitutes an economic liability and is a menace to the public welfare in its current condition. The blight findings include:

·         The existing structure on the property is obsolete due to American with Disabilities Act lack of access to handicap accessible bathrooms and lack of fire exits along the rear of the building.

·         The existing site lacks public sidewalk and the building setback from State Highway 14/83 is inadequate.

·         The site has inadequate drainage and experiences pooling of water which provides a breeding ground for mosquitoes.

·         The site lacks adequate fire protection on a petroleum distribution site.

·         The site has geographical limitations due to the existing railroad line at the rear.

·         A majority of the site does not have any surfacing and particulate matter is displaced into the air when the trucks turn in to the dirt-gravel parking lot. The particulate matter degrades the air quality of the City.

·         The existing site lacks adequate access, interior parking circulation, adequate paved parking areas, and adequate pedestrian access.

c.       The District constitutes a blighted area as defined in SDCL Chapter 11-9.

3.      Findings of Maximum Percentage of Tax Incremental Districts. The aggregate assessed value of the taxable property in the District, plus all other tax incremental districts, does not exceed ten percent of the total assessed valuation of the City.

4.      Improvements Substantially Enhance District. Improvements to the District are likely to substantially enhance the value of all property in the district and are necessary for economic development within the city.

5.      Creation of District. There is hereby created, pursuant to SDCL Chapter 11-9 the Tax Incremental District Number Six, City of Pierre (the “District”).  The District is hereby created on the day this resolution became effective which shall be twenty days after publication.

6.      Designation of District Boundaries. The District shall have boundaries which shall include the following described real property:

      806 & 808 W. Sioux Avenue, Pierre, South Dakota

      All of Lot 1, Governor’s Inn Addition;

      All of Pam Outlot 1;

      All of Peavey’s Outlots 1 and 2;

      All of Block 1, Haggar and Tidball Addition;

      All of Chamales Addition.

This being the time and place set for a public hearing for the application for Retail Malt Beverage and Retail Wine license for Pier 347 Coffee House, Mayor Gill opened the meeting. Denise Gehring, business owner, explained that she recently purchased the business and plans to remain smoke-free, have extended hours beginning June 14th, and provide low-key musical entertainment during the evening hours. The entertainment includes open mic night, acoustical music, and a women’s book club. Denise has been working with the Pierre Police Department to create a plan and system to avoid selling to minors. Police Chief Bob Grandpre commented that Denise has been open to working with the PD and plans to continue to work together until a plan and system is in place. Being no one else present to comment, Mayor Gill closed the public portion of the hearing. Commissioner Mehlhaff moved and Commissioner Harding seconded to approve the Retail Malt Beverage and Retail Wine License for Pier 347 Coffee House. Unanimous approval.

 

Kelly Stout, USDA North Central Resource Conservation and Development Program Coordinator, presented information about the program. Kelly explained that the program empowers rural people to help themselves and provides a networking tool to assist communities build partnerships. Kelly has been meeting with each Community in his 8 County Region to explain his program and to offer networking assistance. Mayor Gill recommended that Scott Carbonneau, Community Development Coordinator, get in contact with Kelly and thanked Kelly for the information and making the contact.

 

Tom Farnsworth, Park & Recreation Director, presented a list of requests from the Oahe Days Arts Festival and provided staff recommendations. Scott Olson, Committee Chair, explained that the events are similar as they have been in past years. Minor changes include the requested street closure on Island View Drive from Fort to Central and new parade route from Riggs High down Capital and down Pierre Street. The street closure request is to increase safety in the area of the motor cross bike show and the new parade route is at the request of the Downtown Association and the Capital Centennial Celebration Committee. Commissioner Goodman moved and Commissioner Mehlhaff seconded to approve the Oahe Days Arts Festival request list per the staff recommendations. Unanimous approval.

 

Commissioner Goodman moved and Commissioner Harding seconded to adjourn. 6:37pm Unanimous approval.
