LICENSING OF MECHANICAL INSTALLERS
Section 10-20-101 to 199, inclusive. Mechanical Installers – general provisions.
Section 10-20-101. License required.
All mechanical installers doing work within the City of Pierre will be required to be licensed by the City of Pierre.

Section 10-20-102. Mechanical Trade Definitions
1. A "mechanical contractor" is any person representing or operating under the auspices of a firm or corporation with six years experience in and qualified and skilled in the planning, superintending and the practical installation of mechanical systems, and otherwise qualified and licensed to contract for mechanical installations and conduct the business or mechanical work and familiar with the laws, rules and regulations governing the same.
2. A "mechanical installer" is any person, with four years experience in the installation of mechanical equipment, other than a mechanical contractor who, as his principal occupation, is engaged as an employee of, or otherwise working under, the direction of a mechanical contractor, and who is lawfully qualified and licensed as a mechanical installer pursuant to the provisions of this chapter.
3. A "mechanical apprentice" is any person other than a mechanical installer or mechanical contractor who is engaged in working as an employee of a mechanical contractor under the immediate and personal supervision of a mechanical installer learning and assisting in the installation of mechanical systems. No apprentice shall be in charge of any phase of work.

Section 10-20-103. Fees for Mechanical Installers Licenses.

If the license fee is not renewed prior to March 1, it shall be considered a new license and the fee shall be an initial fee.

Section 10-20-104. License Issuance - Present Practitioners.
1. A mechanical license shall be issued to every person who makes application for such license, pays the required fee and successfully passes the examination conducted by the Board of Appeals and Examiners provided, however, that the board may approve the issuance of such license to any person who makes application therefor, pays the required fee and presents to the board a valid, current mechanical license issued to him by any other governmental agency giving an examination the scope and character of which, in the opinion of the board, is at least equal to that given by the Board of Appeals and Examiners. A Certificate of Insurance shall be required of every mechanical contractor and shall be on file with the City of Pierre Finance Officer.
2. All persons actively practicing mechanical services for more than ninety (90) days before the passage of this chapter may obtain a mechanical license without testing. All persons to whom this chapter applies shall pay all fees and complete all applications required by this chapter to be so licensed. Any person falling under the provisions of this ordinance who is found to be in violation of the ordinance by the Building Inspection Department and is so reported to the mechanical Board, shall have their licenses revoked at the discretion of the Mechanical Board. These persons shall be required to test to receive a license to do mechanical work.
All license fees as provided in this chapter shall be payable to the City Finance Officer who shall issue the license and shall be credited by him to the general fund. All licenses are issued for the calendar year and fees will not be pro-rated.

Section 10-20-105. Expiration of License - Reexaminations.
Every license issued pursuant to this chapter shall remain in force and effect until January 1st of the succeeding year unless canceled or revoked prior to such time. Any person failing to renew the license within this time shall be required to re-test.
Any person who fails to pass the examination as prescribed by the Board of Mechanical Examiners, may apply for re-examination after the expiration of thirty (30) days. Should such person fail to pass the second time, the board may refuse a third application until after the expiration of six (6) months.

Section 10-20-106. Violations and Penalties.
Any person, firm or corporation violating any of the provisions of this chapter shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punishable by a fine of not to exceed two hundred dollars ($200.00) or by imprisonment in the county jail for not to exceed thirty (30) days, or by both such fine and imprisonment. Upon written notice by the Mechanical Inspector, each separate day or any portion thereof during which any violation of this chapter continues shall be deemed to constitute a separate offense, and upon conviction thereof shall be punishable as herein provided.
