LICENSING OF LOCKSMITH
Section 10-19-101 to 199, inclusive. General provisions.
Section 10-19-101. Definitions.
For the purpose of this ordinance, the word "locksmith" shall mean any person, firm, partnership or corporation in the business of opening locks of automobiles, other vehicles and machinery, homes, stores and other buildings by the use of tools or keys or otherwise.

Section 10-19-102. License Required.
Every locksmith must secure a license from the City of Pierre to practice his trade in the City of Pierre.

Section 10-19-103. Requirements.
Each applicant must:
A) Be a citizen of the United States of America;
B) Be of good moral character, and in making the determination whether or not to issue a license to the applicant the City Commission shall take into consideration:
1. Penal History. All convictions, the reason therefor and the demeanor of the applicant subsequent to his release.
2. General personal history. Such other facts relevant to the general personal history of the applicant as the city shall find necessary for a fair determination of the eligibility of the applicant.
C) Be a current member and maintain membership in either the National Locksmith Association or the Associated Locksmiths of America.

Section 10-19-104. Organization Requirements.
If the applicant is a firm, partnership or corporation, all members of such organization shall be required to meet the qualifications of an individual applicant as hereinabove stated.

Section 10-19-105. Fees.
The application must be accompanied by a certified check or money order in the sum of $100.00. An annual license fee renewal of $15.00 will be required each year in January. The city will provide an identification card as part of the fee.

Section 10-19-106. Violation.
Any license issued pursuant to this ordinance may be revoked for violation of any of the provisions of this ordinance upon notice and hearing.

Section 10-19-107. Employment Restrictions.
No licensee shall employ any person who has been convicted of a felony or who is addicted to the use of intoxicating liquors or controlled drugs or substances.

Section 10-19-108. Identification.
The licensee, if an individual, and each employee thereof, shall carry with him when performing his trade the license described herein or a photocopy thereof. In addition, the licensee, if an individual, and each employee thereof, shall carry an identification card which will be issued by the Chief of Police of the City of Pierre. Upon leaving employment, the identification card shall be surrendered to the Chief of Police.

Section 10-19-109. General Liability Insurance Required.
Any person, firm, partnership or corporation holding a license hereunder shall provide general liability insurance covering the licensee and each employee thereof in the sum of $100,000.00 per person and $300,000.00 per occurrence in full force and effect during the term of the license. Evidence of such insurance shall be furnished to the city upon request.

Section 10-19-110. Employee Termination.
At the termination of employment by an employee of the licensee or the acceptance of employment at another licensee, notice of such termination or acceptance must be given by the licensee in writing to the Chief of Police.

Section 10-19-111. Hours of Service
Locksmiths licensed under this section are required to provide twenty-four (24) hour service. This can be accomplished through the carrying of a pager or cell phone and by providing the Pierre Dispatch Center an on-call list for after normal business hour contact.
