Section 10-5-101. Application and fee for circuses, carnival, and other exhibition license - deposits for cleaning-up and utilities.
It shall be unlawful for any person or persons owning or operating any circus, menagerie, wild west show, rodeo, side show, or similar exhibition to give or exhibit it without first having procured from the commission a license to do so in the manner provided in Article 1 of this chapter and paying to the city finance officer the license fee hereinafter specified. Application for such license shall be made to the commission. No license shall be issued to any carnival company, street carnival, or similar exhibition, except when the operation of such carnival company, street carnival, or similar exhibition is to be sponsored by a local civic organization or governmental entity, the proceeds of the operation of which are intended for the benefit of a specific civic program, in which case the said sponsoring civic organization shall procure a license in the manner herein provided. The amount of the fee for such license shall be twenty-five dollars ($25.00) per day. In the event that a governmental entity sponsors the circus, carnival, or other exhibition the City Commission may waive the fee.
The carnival company, street carnival, or similar exhibition shall also deposit with the city finance officer an amount as determined by the street commissioner for the necessary cleaning of the carnival area at the conclusion of the operations of the aforementioned company or companies.
The final amount of the bill for the cleaning of the carnival area shall be determined by the street commissioner at the conclusion of the operations of the said company or companies and the city finance officer shall apply the deposit against such bill refunding to the said company or companies any amount of the deposit in excess of the amount of the bill or collecting any amount which the final bill may exceed the amount deposited.
Should the carnival company, street carnival, or similar exhibition need connection to and use of city utilities, the company or companies shall also deposit with the city finance officer an amount as determined by the public utilities commissioner for such connection to and use of city utilities. The final amount of the bill for such utilities shall be determined by the public utilities commissioner at the conclusion of the operation of the said company or companies and the city finance officer shall apply the aforementioned deposit against such bill, refunding to the said company or companies any amount of the deposit in excess of the amount of the bill or collecting any amount which the final bill may exceed the amount deposited.
The carnival company, street carnival, or similar exhibition may be required by the City Commission to provide adequate police protection during the operating hours of the carnival or exhibition, at the expense of carnival or exhibition. Such police protection shall be approved by the Chief of Police.
